1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Klon mobile application and related services ("Klon," "the app," "we," "us"). By creating an account or using Klon, you agree to be bound by these Terms. If you do not agree, please do not use the app.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Klon. If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.

4. License to use Klon

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Klon app for your personal, non-commercial use.

5. Your content and ownership of generated portraits

You retain ownership of the photos you upload. By uploading a photo, you grant Klon a limited license to process that photo solely to generate your personalized AI portraits and videos, as described in our Privacy Policy.

You own all the AI-generated portraits and videos created from your own uploaded photos, and may use them for personal and commercial purposes, subject to the acceptable use restrictions in Section 6.

You represent that you have the right to upload any photo you submit, and that doing so does not infringe the rights of any third party.

6. Acceptable use

You agree not to use Klon to:

• Upload photos of another person without their consent.
• Generate or distribute content that is unlawful, defamatory, harassing, or sexually explicit.
• Impersonate any person or entity, or misrepresent AI-generated content as an unedited photograph in a misleading context.
• Attempt to reverse-engineer, decompile, or interfere with the app or its underlying models.
• Use automated means to access the app or extract data without our written permission.

7. Purchases and subscriptions

Certain styles and features may be offered as one-time purchases through the Apple App Store or Google Play. All purchases are processed by the respective platform and are subject to that platform's payment terms and refund policies.

8. Intellectual property

Klon, including its app, branding, styles library, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you, except for the limited license described in Section 4.

9. Termination

We may suspend or terminate your access to Klon if you violate these Terms or if we discontinue the app. You may stop using Klon and delete your account at any time through the app's account settings.

10. Disclaimers and limitation of liability

Klon is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI-generated portraits will meet your expectations in every instance.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the app.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Klon AI is incorporated, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means before the changes take effect.
